Please take notice that the Town of Hammonton has applied to the New Jersey Pinelands Commission for approval of an application for public development. The proposed public development is to authorize an extension of the town water system to serve areas impacted by contaminated groundwater, as documented by NJDEP’s Office of Wellfield Remediation. Areas to be served include:
Basin Road – from the end of the current water system to Union Road;
Union Road – from Basin to Oak Roads;
Pine Road – from the White Horse Pike to Union Road;
Oak Road – from the White Horse Pike to Union Road;
White Horse Pike (north side) from the end of the current system at Pine Road to Oak Road.
The commission may take action on the application after ten (10) days from the date the notice is published and mailed. The application is on file and available for inspection by appointment at the Pinelands Commission office. Interested persons may comment to the Pinelands Commission within ten (10) days of the date of this notice. Comments should be sent to the Pinelands Commission, P.O. Box 7, New Lisbon, New Jersey 08064, phone (609) 894-7300. Any person who provides comments or requests a copy of the executive director’s findings and conclusions shall be provided a copy of said findings and conclusion and that any interested person who is aggrieved by said determination is entitled to a hearing by appealing the determination.

ENTITLED “Trash Collection”

WHEREAS, the Mayor and Council of the Town of Hammonton desire to amend Article II, Chapter 241-19 (Section C) of the Code of the Town of Hammonton entitled “Trash Collection” as follows:
The Town of Hammonton shall not be responsible for furnishing collection vehicles or personnel to remove and dispose of the solid waste of nonresidential users within the Town of Hammonton, “However, the Town shall assume responsibility for the collection of the solid waste generated by the two volunter fire companies and the three military service organizations (American Legion, Veterans of Foreign Wars and Disabled American Veterans) at their respective principal facilities.”
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Town Council of the Town of Hammonton, County of Atlantic, State of New Jersey that Article II, Chapter 241-19 (Section C) be amended;

I. PURPOSE
The Town of Hammonton desires that all it’s employees recognize that polices and procedures are adopted to insure an efficient, fair, safe, and enjoyable work environment. Written rules of dress, conduct, conditions of employment, etc. are important to create that environment. It is the policies, procedures, rules and regulations outlined in the Employee handbook as the official guideline which employees must adhere to. This Handbook is not intended to be construed actually or by implication as an employee contract.
II. ADOPTION AND NAME
The employee handbook which has been created through the efforts of the Town Solicitor, the Town Risk Manager, the Town Clerk/Administrator, and the Deputy Town Clerk is hereby adopted and shall be originally known as the “Employee Handbook of the Town of Hammonton.
III. MODIFICATION
As laws and society change, there will always be the need for modification to the policies and procedures of the town. Any modification to the handbook, once adopted, shall be done with the same formality as it’s original creation. The modification must be set forth in writing and received by the entire governing body, accepted by a majority, and notice to all Town Employees.
IV. This Ordinance shall take effect upon approval and publication according to law.

WHEREAS, the Mayor and Council wish to change the evaluation process as follows:
1. A separate evaluation form has been created and will now be used for police as well department heads;
2. All employees will be evaluated on their anniversary;
3. All evaluations are subject to review and approval of the Town Administrator;
4. The Town Administrator will be responsible for evaluation of department heads;
5. The evaluations will now be reviewed by Mayor and Council prior to employee/department head promotions;
6. The evaluations will be used for other circumstances such as hiring part time to full time status, review of performance after probationary period or reprimand, or any other reason as deemed necessary by the Town Administrator;
7. The evaluation now requires supporting documentation for negative review;
WHEREAS, the employee or department head will continue to have the ability to comment or appeal before their council committee the job performance evaluation given to them;
WHEREAS, the job evaluation does not eliminate the department head, Town Administrator’s or Mayor and Council’s ability to reprimand (verbally or in writing or to suspend).

CHANGE ORDER #4
TO THE JPS CONSTRUCTION, INC. CONCERNING THE WELL #7 PROJECT – STRUCTURAL UPGRADES

WHEREAS, the Mayor and Town Council of the Town of Hammonton, County of Atlantic, State of New Jersey authorized a construction contract to JPS Construction on February 27, 2006 in the amount of $671,000.00; and
WHEREAS, after the contract was awarded, issues regarding the placement of said well were discussed with SJ Gas Company who have the responsibility of performing a site remediation project; and
WHEREAS, the discussions between the Town and SJ Gas resulted in a mutually agreeable decision to relocate the proposed Well #7 from the Lincoln Avenue site to that of the Well #5 site located on 14th Street; and
WHEREAS, the purpose of agreeing to relocating the well involved the practicality of avoiding the Town’s construction effort from becoming in conflict with SJ Gas’s future remediation activity; and
WHEREAS, due to the change of location regarding the placement of Well #7 from the Lincoln Street Complex to the 14th Street site, the Town authorized Change Order #1 on April 23, 2007 in the net amount of $68,891.10, to increase the project from $671,000.00 to $739,891.10; and
WHEREAS, with the relocation of Well #7 from the Lincoln Street Complex to the 14th Street site, the Town still remain desirous of improving certain facilities and equipment at the Lincoln Street complex that was part of the original contract and remained so with Change Order #1; and
WHEREAS, on July 9, 2007, the Town issued Change Order #2 to JPS Construction in the amount of $7,000.00 to address additional roof repairs to the operations building at the Lincoln Street Complex; and
WHEREAS, on July 23, 2007, the Town issued Change Order #3 to JPS Construction in the amount of $48,732.00 to address electrical upgrades at the Well #5 site; and
WHEREAS, the Water and Sewer Subcommittee have reviewed additional issues involving the construction activity at the Lincoln Street Complex; and
WHEREAS, certain improvements to the Well #3 pump house and the chemical building at the Lincoln Street Complex caused the Water and Sewer Subcommittee to reevaluate the most efficient means of upgrading the facilities; and
WHEREAS, due to age and structural deficiencies at both the Well #3 pump house and the chemical building at the Lincoln Street complex, it was determined that it would be in the Town’s best interest to rehabilitate each facility using the existing structure; and
WHEREAS, the structural modifications at the Lincoln Street complex will involve an increase to the existing JPS Construction contract; and
WHEREAS, the structural changes also as detailed in correspondence from Adams, Rehmann & Heggan dated October 31, 2007 are in the net amount of $30,537.00; and
WHEREAS, these changes are presented as Change Order #4, entitled Structural Modifications at the Lincoln Street complex; and
WHEREAS, after reviewing the issues and expense of proposed Change Order #4, the Water and Sewer Subcommittee is recommending to the General Council approval of same; and
WHEREAS, the issuance of this change order will prove beneficial to the reliability Town’s Water System operations and promote the health of safety of its residents; and
WHEREAS, JPS Construction has been previously awarded Change Orders #1 - #3 throughout the contract that begin to approach the 20% maximum threshold; and
WHEREAS, the issuance of the previous Change Orders #1 - #3 coupled with Change Order #4 places the contract at 23.1% above the original bid; and
WHEREAS, the Public Contracts Law requires a procedure to be followed in the event the 20% is exceeded; and
WHEREAS, in accordance with N.J.A.C. 5:30-11.9 Provisions for Change Orders Which Exceed 20% Limitations, the law requires that the 20% threshold could be exceeded when unforeseen conditions are combined with a situation that renders an execution of a new contract as an unreasonable interference with the efficient completion of the work; and
NOW THEREFORE BE IT RESOLVED THAT the Town of Hammonton will be issuing JPS Construction Change Order #4 in the amount of $30,537.00 and when added together with the previously issued Change Orders #1 - #3 ($124,623.00) will exceed the 20% limit raising the total change order value above the original bid to $155,160.00 for the following reasons:
• The Contractor is currently mobilized and to address these items outside the scope of this project will ultimately cost the Town of Hammonton additional funds.
• Avoids the need to issue a new contract that will consequently increase the cost of the structural repairs contemplated under Change Order #4.
• In the case of the Lincoln Street complex, the existing structures to be modified and reconstructed are in excess of 80 years old.
• Although new roofs were proposed for the Well #3 pump house and Chemical Building, the windows, doors and certain structural problems warranted a reconsideration of the repairs to said facilities.
• It was determined that the existing structures will most likely require attention at some point in the near future.
• After further review of the necessary structural repairs, it became apparent that a comprehensive reconstruction and repair of the existing structures would be more economical for the long term operation of the Water Department.
BE IT FURTHER RESOLVED THAT the Town of Hammonton has performed the following legal requirements:
1. By the adoption of this resolution, the Town has assured that the issuance of the composite value of Change Orders #1-#4 is under Public Contracts Subchapter and is proper and allowable.
2. This resolution is passed prior to execution of the change order.
3. Print in the authorized newspaper a copy of the resolution including the amount to be expended, the original contract price and the need for the additional work.
4. Said actions must be reported in the annual audit. On or before the last day of February, the Clerk shall report to the Division of Local Government Services all changes from the preceding year that exceeded the 20% limitation. This report shall be made on a form provided by the Division of Local Government Services.
BE IT FURTHER RESOLVED THAT the Town of Hammonton has authorized Change Order #4 in the total amount of $30,537.00 subject to the certificate of availability of funds from the CFO.

CONCERNING PROPOSED FLOODPLAIN DEVELOPEMNT

2008 SMALL CITIES PROGRAM

In accordance with the provisions of the US Water Resources Council’s Flood Plain Management Guidelines for Implementing Executive Order 11988 (43 CFR 6030) the Town of Hammonton announces its findings and intent to proceed with the project described below:
2008 Community Development Block Grant funds will be used for creation of a Senior Center at Hammonton Lake Park. This activity includes the expansion and renovation of the existing Town Recreation Building for conversion to a Senior Center.
Explanation: The Town of Hammonton has completed an evaluation concerning potential impacts on the floodplain and possible alternative actions. The conclusion was that while the site is located in the 100 Year Flood Plain the overall expansion of the building will not create a significantly greater foot print. No other sites or actions were available that would allow the Town to provide acceptable Senior facilities with adequate space and accessibility.
Alternatives considered were choosing another location and the alternative of no action. The Town could not identify another publicly owned site that was accessible and cost effective. The second was found to be impractical as No Action will prevent the Town from addressing the social, educational, health and nutritional needs of the Senior population of Hammonton.
The proposed activities conform to applicable State and Local Flood Plain Protection Standards and are appropriate for the criteria of the National Flood Insurance Program.
Because the project is local in nature, publication of this Notice in a newspaper of local circulation has been determined to be appropriate. Upon publication and circulation of the Notice of Findings and Public Explanation, written comments will be received at the address below for a period of 7 days. Comments should be received on or before October 11, 2007.
The creation of a Senior Center at the Town Recreation Building on Hammonton Lake will cause negligible infringement upon the 100 year Flood Plain, and the Town of Hammonton has concluded that the above referenced public improvements will not result in new or adverse effects on the natural or beneficial flood plain values.

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF HAMMONTON, IN THE COUNTY OF ATLANTIC, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS:
Section 1. The improvement described in Section 3 of this bond ordinance is hereby authorized to be undertaken by the Town of Hammonton, New Jersey as a general improvement. For the improvement or purpose described in Section 3, there is hereby appropriated the sum of $80,000, including the sum of $4,000 as the down payment required by the Local Bond Law. The down payment has been made available in the Capital Improvement Fund.
Section 2. In order to finance the cost of the improvement or purpose not covered by application of the down payment, negotiable bonds are hereby authorized to be issued in the principal amount of $76,000 pursuant to the Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law.
Section 3. (a) The improvement hereby authorized and the purpose for the financing of which the bonds are to be issued is Boyer Avenue recreation improvements, including all costs necessary or incidental thereto.
(b) The estimated maximum amount of bonds or notes to be issued for the improvement or purpose is as stated in Section 2 hereof.
(c) The estimated cost of the improvement or purpose is equal to the amount of the appropriation established in this ordinance.
Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer; provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer. The chief financial officer shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer’s signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of the Local Bond Law. The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser.
Section 5. The capital budget of the Town of Hammonton is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Clerk and is available there for public inspection.
Section 6. The following additional matters are hereby determined, declared, recited and stated:
(a) The improvement or purpose described in Section 3 of this bond ordinance is not a current expense. It is an improvement or purpose that the Town may lawfully undertake as a general improvement, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby.
(b) The period of usefulness of the improvement or purpose within the limitations of the Local Bond Law, according to the reasonable life thereof computed from the date of the bonds authorized by this ordinance, is 15 years.
(c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such statement shows that the gross debt of the Town as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $76,000, and the obligations authorized herein will be within all debt limitations prescribed by that Law.
(d) An aggregate amount not exceeding $16,000 for items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated herein for the purpose or improvement.
Section 7. Any grant moneys received for the purpose described in Section 3 hereof shall be applied either to direct payment of the cost of the improvement or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are so used.
Section 8. The chief financial officer of the Town is hereby authorized to prepare and to update from time to time as necessary a financial disclosure document to be distributed in connection with the sale of obligations of the Town and to execute such disclosure document on behalf of the Town. The chief financial officer is further authorized to enter into the appropriate undertaking to provide secondary market disclosure on behalf of the Town pursuant to Rule 15c2-12 of the Securities and Exchange Commission (the “Rule”) for the benefit of holders and beneficial owners of obligations of the Town and to amend such undertaking from time to time in connection with any change in law, or interpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally recognized bond counsel, consistent with the requirements of the Rule. In the event that the Town fails to comply with its undertaking, the Town shall not be liable for any monetary damages, and the remedy shall be limited to specific performance of the undertaking.
Section 9. The full faith and credit of the Town are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the Town, and the Town shall be obligated to levy ad valorem taxes upon all the taxable real property within the Town for the payment of the obligations and the interest thereon without limitation of rate or amount.
Section 10. This bond ordinance shall take effect 20 days after the first publication thereof after final adoption, as provided by the Local Bond Law.

In accordance with the provisions of the US Water Resources Council’s Flood Plain Management Guidelines for Implementing Executive Order 11988 (43 CFR 6030), the Town of Hammonton is requesting public comment on their evaluation of a proposal to spend 2008 Community Development Block Grant funds for creation of a Senior Center at Hammonton Lake Park. This activity includes the expansion and renovation of the existing Town Recreation Building for conversion to a Senior Center. This building is presently in the 100 year Flood Plain.
This notice is being issued prior to final action granting project approval so as to provide opportunity for early public review.
The proposed action may affect the Flood Plain of the Town of Hammonton. The project site is located in an area predicted to be inundated by a flood event having a one percent probability of recurring each year (this is the 100 year base flood). The Town of Hammonton is reviewing the action for its effects on the passage of floodwaters, for alternatives to flood plain development, and for consistency with Federal, State, and Local policies and regulations on flood plain management.
The Town of Hammonton invites all interested persons to participate in the decision whether to assist with Federal funds for this proposed flood plain development. Besides its publication in this paper, this notice is being distributed to community groups and public agencies. AN ORDINANCE AMENDING ORDINANCE #1-1997
ESTABLISHING A PURCHASE ORDER PROCEDURE

BE IT ORDAINED by the Mayor and Council of the Town of Hammonton, in the County of Atlantic and State of New Jersey, as follows:
SECTION I. PURPOSE
In order to provide for control and accountability over all expenditures by the Town of Hammonton, and in recognition of the essential need to maintain viable procedures so that the business operations of local government may proceed in an efficient and timely manner, this ordinance shall be adopted which shall set forth the procedures to be followed in order to make purchases by any Department Head (or in their absence, the next in charge in the Department) of the Town of Hammonton.
SECTION II. APPLICABILITY
The regulations and requirements outlined herein shall be applicable for all purchases by all Department Heads of the Town of Hammonton.
SECTION III. PROCEDURES
It is determined that each Town Department shall be allocated funds for the annual operation of said department. The Head of that Department is responsible for purchases on behalf of the department and shall:
1. First obtain a verbal or written quote/cost for the proposed or requested purchase.
2. Accurately complete and sign a requisition and submit same to the Finance Department of the Town of Hammonton.
3. Wait until the Finance Department has issued a purchase order (which authorizes the purchase to be made) describing the item to be purchased and cost of same, before actually making the purchase. Head of Department shall issue the purchase order to the vendor in person or by fax and this authorizes the vendor to remit the product or service and guarantees payment of same will be made by the Town of Hammonton so long as the product or service is remitted to the satisfaction of the Town of Hammonton.
4. If a product or service must be ordered, then it is the department heads responsibility to review the monthly list of bills to be paid and sign off on same that all bills listed are accurate and have been received to the satisfaction of the Town of Hammonton. Products or service on order and not received by the Town should not be paid for ahead of time. The purchase order is the legal document authorizing the order or purchase and guaranteeing payment of same.
5. Department Head is responsible for working within his/her annual budget. This means Department Head should anticipate all possible expenditures for budget year and pre encumber those funds so that he/she may work with the remaining department budget balance.
6. Department Head may not exceed his/her allocated budget in any given year.
7. Department Head must review his/her departments budget balances which appear on the monthly council meeting agenda’s e mailed to department head under the Town Clerk Report.
8. For purchases/requisitions exceeding $250.00 the Council Committee must also sign requisition before it is submitted to the Finance Office for review and approval and issuance of a purchase order.
9. For purchases for products or services exceeding $3,150.00 or the percentage of the Bid Threshhold as determined by the State of New Jersey for any particular year, department head must attempt to receive 2 or more quotes and attach same to his/her requisition prior to Council Committee signature.
10. For purchases exceeding $17,500 or the amount set by State of New Jersey (Pay to Play Law) in any given budget year, Department Head must contact Finance Office and/or Town Clerk/Administrator Office to ascertain how the purchase may be made.
11. For purchases exceeding $21,000 or the amount set by State of New Jersey Bidding Laws in any given year, Department Head must contact Finance Office and/or Town Clerk/Administrator Office so that they may formally bid that product or service.
12. Multiple purchases of the same product or service in any given budget year must be calculated in total to determine how the purchase can legally be made.
13. Should an emergency arise, department head must contact Finance Office and/or Town Clerk/Administrator Office for direction prior to making any purchase for product or service.
14. Should the Department Head receive a letter during any given budget year from the Finance Office and/or Town Clerk/ Administrator Office mandating “no further spending” in his/her department due to previous overexpenditures and/or lack of sufficient funding in that department, department head must comply. Should department head continue to make purchases at any point after receiving this letter, he/she may automatically be suspended.
15. Should a department head turn in an incomplete requisition to the Finance Office it will be returned with a letter stating reason for same and if the purchase pre dates the requisition and purchase order, it will be taken to Mayor and Council for review and department head will be subject to disciplinary action for the unauthorized purchase.
SECTION IV. REPEALER
Any ordinance or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed as to such inconsistency only.
SECTION V. COMPLIANCE WITH STATE LAW.
Any purchase made by the Town of Hammonton is still governed by the State of New Jersey laws.
SECTION VI. EFFECTIVE DATE.
This ordinance shall take effect upon publication and passage according to law.

BOND ORDINANCE PROVIDING FOR BOYER AVENUE RECREATION IMPROVEMENTS IN AND BY THE TOWN OF HAMMONTON, IN THE COUNTY OF ATLANTIC, NEW JERSEY, APPROPRIATING $80,000 AND AUTHORIZING THE ISSUANCE OF $76,000 BONDS OR NOTES OF THE TOWN TO FINANCE PART OF THE COST THEREOF.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF HAMMONTON, IN THE COUNTY OF ATLANTIC, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS:
Section 1. The improvement described in Section 3 of this bond ordinance is hereby authorized to be undertaken by the Town of Hammonton, New Jersey as a general improvement. For the improvement or purpose described in Section 3, there is hereby appropriated the sum of $80,000, including the sum of $4,000 as the down payment required by the Local Bond Law. The down payment has been made available in the Capital Improvement Fund.
Section 2. In order to finance the cost of the improvement or purpose not covered by application of the down payment, negotiable bonds are hereby authorized to be issued in the principal amount of $76,000 pursuant to the Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law.
Section 3. (a) The improvement hereby authorized and the purpose for the financing of which the bonds are to be issued is Boyer Avenue recreation improvements, including all costs necessary or incidental thereto.
(b) The estimated maximum amount of bonds or notes to be issued for the improvement or purpose is as stated in Section 2 hereof.
(c) The estimated cost of the improvement or purpose is equal to the amount of the appropriation established in this ordinance.
Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer; provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer. The chief financial officer shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer’s signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of the Local Bond Law. The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser.
Section 5. The capital budget of the Town of Hammonton is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Clerk and is available there for public inspection.
Section 6. The following additional matters are hereby determined, declared, recited and stated:
(a) The improvement or purpose described in Section 3 of this bond ordinance is not a current expense. It is an improvement or purpose that the Town may lawfully undertake as a general improvement, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby.
(b) The period of usefulness of the improvement or purpose within the limitations of the Local Bond Law, according to the reasonable life thereof computed from the date of the bonds authorized by this ordinance, is 15 years.
(c) The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such statement shows that the gross debt of the Town as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $76,000, and the obligations authorized herein will be within all debt limitations prescribed by that Law.
(d) An aggregate amount not exceeding $16,000 for items of expense listed in and permitted under N.J.S.A. 40A:2-20 is included in the estimated cost indicated herein for the purpose or improvement.
Section 7. Any grant moneys received for the purpose described in Section 3 hereof shall be applied either to direct payment of the cost of the improvement or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are so used.
Section 8. The chief financial officer of the Town is hereby authorized to prepare and to update from time to time as necessary a financial disclosure document to be distributed in connection with the sale of obligations of the Town and to execute such disclosure document on behalf of the Town. The chief financial officer is further authorized to enter into the appropriate undertaking to provide secondary market disclosure on behalf of the Town pursuant to Rule 15c2-12 of the Securities and Exchange Commission (the “Rule”) for the benefit of holders and beneficial owners of obligations of the Town and to amend such undertaking from time to time in connection with any change in law, or interpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally recognized bond counsel, consistent with the requirements of the Rule. In the event that the Town fails to comply with its undertaking, the Town shall not be liable for any monetary damages, and the remedy shall be limited to specific performance of the undertaking.
Section 9. The full faith and credit of the Town are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the Town, and the Town shall be obligated to levy ad valorem taxes upon all the taxable real property within the Town for the payment of the obligations and the interest thereon without limitation of rate or amount.
Section 10. This bond ordinance shall take effect 20 days after the first publication thereof after final adoption, as provided by the Local Bond Law.

NOTICE TO BIDDERS
1. BIDS: Sealed Bids for the Central Avenue Roadway Project, in the Town of Hammonton, will be received at 10:00 a.m. on Friday September 7, 2007, at which time Bids will be publicly opened and read aloud at the Council Chambers, located at 100 Central Avenue, Hammonton, NJ 08037. Bids will not be accepted after the specified time.
The project will consist of the Reconstruction of Hammonton-Pleasant Mills Road (AKA Central Avenue) from Bellevue Avenue (US Rte. #54) to the White Horse Pike (US Rte. #30). Curb and sidewalk replacement as well as drainage improvements will be included within the project construction scope.
Accordingly, the Town of Hammonton will award the project to the qualified Bidder who submits the lowest responsible bid price for the total project construction.
Bids must be on the official Bid Form which can be obtained from the Engineer, at the offices of Adams, Rehmann & Heggan Associates, Inc., 150 N. Second Street, PO Box 579, Hammonton, NJ 08037 and accompanied by a Consent of Surety, a Non-Collusion Affidavit, other documents required pursuant to the specifications, and a certified check, cashier’s check or bid bond in the amount of 10% of the amount bid but not in excess of $20,000.00, and be delivered at the place on or before the hour named above. Each Bid must state the name and address of person, firm and corporation interested in the same as a principal. Bids must be submitted in an opaque sealed envelope, addressed to the Town Clerk, Town of Hammonton, 100 Central Avenue, Hammonton, NJ 08037 and identified as “Bid – Central Avenue Roadway Project.”
Specifications provide for receipt of Bids by mail. Those Bids which are mailed to the contracting unit shall be sealed, properly marked and shall only be opened for examination at such time and place as all Bids received are unsealed and announced.
The Mayor, Town Council and its Solicitor (hereinafter referred to as Owner) will be the sole discretionary body for consideration or rejection of the Bids.
2. BID DOCUMENTS: The Specifications, Drawings and Bid Form for the project can be obtained at a cost of $100.00 from the office of the Engineer, Adams, Rehmann & Heggan Associates, Inc., 150 N. Second Street, PO Box 579, Hammonton, NJ 08037, phone (609) 561-0482, and may be inspected by prospective Bidders during business hours. The Engineer will furnish the Bidder with a copy of the specifications upon receipt of payment (for the cost of the specification preparation).
3. WITHDRAWAL OF BIDS: Any Bid may be withdrawn prior to the above scheduled time for the opening of Bids or any authorized postponement thereof. Bids received after time and date designated shall not be considered. No Bidder may withdrawal a Bid for a period of sixty (60) calendar days after the actual date of the opening thereof.
4. AFFIRMATIVE ACTION REGULATIONS: Bidders are required to comply with the requirements of P.L. 1975, c.127 (NJAC 17:27).
